Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LashLovr website, mobile application, and related services, including any purchase of products (collectively, the "Platform") operated by True Beauty Lashes, Inc. ("LashLovr," "we," "us," or "our").

By accessing, using, or purchasing through the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform or make purchases.

1. Eligibility You must be at least 18 years old to use the Platform or make purchases. By using the Platform, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. User Accounts Certain features, including saving recommendations and making purchases, require creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our discretion.

3. Biometric Features and Consent The Platform includes an optional facial scan feature that uses your device's camera to analyze eye shape for personalized lash recommendations and virtual try-on. Use of this feature is governed by our separate Biometric Information Policy, available at: https://www.inspiretruebeauty.com/pages/biometric-information-policy. 

Before using the facial scan feature, you will be required to review the Biometric Information Policy and provide explicit consent. By consenting and using the feature, you agree to the collection, use, storage, and retention of biometric data as described therein.

4. AI Recommendations Disclaimer Lash recommendations and virtual try-on results are generated by AI and provided for informational and entertainment purposes only. They are not guaranteed to be accurate or suitable for your needs. Always patch-test products and consult professionals as needed. We are not liable for any reliance on AI-generated content.

5. Purchases and E-Commerce The Platform allows you to purchase lash products ("Products"). All purchases are subject to these Terms.

• Product Information: We strive to be accurate in product descriptions, pricing, and images, but we do not warrant that they are complete, reliable, or error-free. Prices are subject to change without notice.
• Orders: By placing an order, you make an offer to purchase Products at the stated price. We reserve the right to accept or reject orders. Orders are not binding until shipped.
• Payment: You agree to provide valid payment information and authorize charges for your order, including taxes and shipping.
• Shipping Policy:
• Free shipping on U.S. orders over $35 USD (after discounts).
• Standard shipping: flat rate $5.95 for orders under $35 USD.
• Processing time: 1–3 business days (excluding weekends/holidays).
• Delivery time: Typically, 5-8 business days after shipment (delays beyond our control are not our responsibility).
• You are responsible for accurate shipping information. We are not liable for lost, stolen, or damaged packages once delivered to the carrier.
• Returns & Refunds: 14-day return policy for unopened Products (see full Return Policy at https://www.inspiretruebeauty.com/pages/shipping-and-returns). Returns must be authorized; shipping costs are non-refundable unless the item is defective.
• Cancellations: Orders cannot be cancelled or modified once shipped.

6. License to Use the Platform We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal purposes in accordance with these Terms.

7. Intellectual Property All content on the Platform, including text, graphics, logos, AI models, recommendation algorithms, software, and product images, is owned by True Beauty Lashes, Inc. or its licensors and protected by intellectual property laws. You may not copy, modify, reverse engineer, or create derivative works without our written permission.

8. User Conduct and Prohibited Uses You agree not to:

• Use the Platform for unlawful purposes or in violation of these Terms.
• Interfere with or disrupt the Platform.
• Attempt unauthorized access.
• Reverse engineer any technology, including facial scan or AI features.
• Upload harmful content or code.
• Harass or harm others.
• Use automated tools without permission.

9. Privacy Your use of the Platform is governed by our Privacy Policy at https://www.inspiretruebeauty.com/pages/privacy-policy and, for biometric features, our Biometric Information Policy at https://www.inspiretruebeauty.com/pages/biometric-information-policy.

10. Termination We may suspend or terminate your access or cancel orders at any time, with or without cause. Provisions that should survive termination (e.g., intellectual property, disclaimers, liability limits) remain in effect.

11. Disclaimer of Warranties The Platform and Products are provided "as is" without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

12. Limitation of Liability To the fullest extent permitted by law, True Beauty Lashes, Inc. shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the greater of $100 USD or the amount you paid us in the last six months.

13. Indemnification You agree to indemnify True Beauty Lashes, Inc. from claims arising from your violation of these Terms or use of the Platform/Products.

14. Arbitration and Class Action Waiver Any dispute shall be resolved by binding arbitration in Orange County, California, under American Arbitration Association Consumer Rules. You waive rights to jury trial and class actions. Each party pays its own costs.

15. Governing Law These Terms are governed by California law, without regard to conflict of laws principles. You consent to exclusive jurisdiction in Orange County courts for non-arbitrable claims.

16. Changes to Terms We may update these Terms. Material changes will be posted with the new effective date. Continued use constitutes acceptance.
